  • Gideon v. Wainwright is about a man who left home his eighth-grade year to go in and out of jail. In 1961 Gideon was charged with breaking and entering which was a felony in Flordia. At his trial, he appeared in a court case with no attorney because he could not afford one. Gideon asked the judge to appoint the counsel and the Judge denied it. He was found guilty and after five years in prison, he wrote an argument to the Supreme Court.
  • The Admendment
  • Gideon argued that when Florida refused to appoint counsel for him, Florida violated the due process clause. The Due process clause says that prevents governments from impacting citizens.
  • The Impact of the Case
  • The Supreme Court decided that people accused of crimes have a right to an attorney no matter what. It is guaranteeing the right to legal counsel for criminal defendants in federal and state court.
  • 6th Amendment: The Due Process Clause of the Fourteenth Amendment. The case shows that you should get an attorney no matter what in court even if you can not afford it.
  • Made improvement to the due of process revolution. The constitution placed a higher value to have a good defence when it comes to court.
