- Linda brown had to walk a mile everyday to get to her school that was specifically made for non white children even though she lived nearby a white school, when her parents tried enrolling her they did not allow it because of her race this happened to the Brown Family and 7 other Families
- A group of 13 Parents including Oliver Brown sued the Topeka School board of education on behalf of their 20 children in federal district court alleging that segregation deprived them of equal protection of the laws under the fourteenth amendment
- Fourteenth Amendment-No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws
- A Panel of three district court judges ruled for the school board, finding that the facilities were largely equal to those for white students the court cited the 1896 supreme court precedent Plessy V, Ferguson which validate seperate but equal accommodations in public transportation but acknowledged the detrimental effect segregation had on non white children
