  • As Ajay comes home after an exhausting day of school, he sits down with his grandfather to discuss with him a few things he had learnt at school that day.
  • Grandpa! In school, we just discussed about the Indian Constitution. Mainly about the Fundamental rights. Do you know anything about it? 
  • Ajay! How was school? What did you learn today? 
  • A discussion on Fundamental rights...
  • Hmm....The last one! Right to Constitutional remedies! Our teacher told us that it is the most important right.
  • Yes Ajay. There are six fundamental rights mentioned in our constitution. But let me ask you, which one did you find the most intriguing? 
  • Right to Constitutional Remedies....?
  • Hmm....I'm not sure about this one grandpa... Could you tell me more about it?
  • Wow! You're doing great! The Right to Constitutional Remedies is indeed the most important Fundamental right. But, do you know why?
  • The Indian constitution is one of the world's longest hand written documents in the world. It is the supreme law governing India. The Constitution of India guarantees it's citizens some Fundamental or basic rights. They have been mentioned in the constitution, Part 3, Article 12 to Article 35.
  • Ajay says that the Right to Constitutional remedies is the most important and intriguing Fundamental right of the six, but why? Let's find out what Grandpa has to say about this...
  • Sure thing! The Right to Constitutional Remedies is merely another fundamental right which makes all the other 5 fundamental rights effective. It guarantees these fundamental rights to the people and enforces them.
  • The Indian constitution lists 6 main Fundamental rights to every Indian citizen which cannot be violated. These rights include - Right to Equality, Right to Freedom, Right against Exploitation, Right to Freedom of Religion, Cultural and Educational Rights and lastly, Right to Constitutional Remedies.
  • What if an individual's fundamental rights have been violated? 
  • Good point Ajay! If someone's rights have been violated, they can immediately reach out to the Supreme or High Courts of India to seek justice. This actually has been written and guaranteed under the Right to Constitutional remedies itself!
  • The Right to Constitutional Remedies is the last out of the six Fundamental rights and is considered the most important out of the six. But why it is so?
  • "Heart and Soul of the Indian Constitution"
  • Ajay, let me tell you one last thing... This particular fundamental right was also called the "Heart and Soul of the Indian Constitution" by Dr. B.R. Ambedkar. Do you know why? It was because, this right made all the other rights effective! Without it, the other rights wouldn't have as much value as they do right now.
  • The Right to Constitutional remedies is the most important fundamental rights of the bunch. It helps in implementing all the other five fundamental rights and empowers them.
  • Oh! I get it now. But grandpa, what if someone's Fundamental rights are violated? Does this right have a role to play in that case too?
  • The right to Constitutional remedies also gives citizens the freedom or the right to approach the courts and seek justice in case their rights have been violated. In case of violation of a fundamental right, the Supreme court and high courts can be approached directly.
  • I see...The Right to Constitutional remedies is extremely important.
  • The Right to Constitutional remedies is indeed, a very important right in our constitution. No wonder it is a part of the six Fundamental rights!
