  • INVESTIGATION
  • BRIEF ASSESSMENT AND DECISION TO CHARGE
  • YOU'RE UNDER ARREST!
  • CHARGING OR COMMENCING A PROCEEDINGS
  • You are charged for murder in the 2nd degree
  • Investigating is when a Crime has been committed and the police are looking into evidence. This evidence will be used in court to put the person who committed the crime in prison. If not enough evidence is found to put someone away they will be free of all charges.
  • HEARING
  • The police will document all the evidence and go through it all. Brief assessments often include prosecutors whose job at this time is to assess what the police have come up with. Deciding whether or not you should not charge someone is the most important bit because this is what will give you your case. A person will be charged if they have reasonable prospects of securing a conviction and the public interest requires a prosecutionthe public interest requires a prosecutio
  • TRIAL
  • The defendant will generally first appear in the local court where they are given the opportunity to plea guilty or not guilty. If they plea guilty they will be sent to a higher court for sentencing. It's a bit different if what you have been accused of is really bad such as murder. If so, a magistrate will read the evidence and decide if there is enough credible evidence to put them to trial
  • SENTENCING
  • Hearings often occur in the magistrates/local court. There isn't a jury, and witnesses are called up to give extra evidence. The judge decides on her/himself if the verdict is guilty or not guilty. If they are proven guilty then the judge will impose a sentence. If the verdict is innocent then all charges will be dropped.
  • I Hereby call a witness to the stand
  • If the defendant has been committed for a trial then it will be held either in the country/district or supreme court. If a matter is sent to the supreme court the CDPP must prepare an indictment. An indictment lists all the offences the defendant has been charged with. During the trial, the prosecution calls witnesses to the stand revealing new information. At the end of the trial, the judge sums up both sides to the jury. The jury leaves the courtroom and all 12 people vote unanimously. judging on what the jury says. the defendant will either be found guilty and be imposed a sentence or be innocent and all charges will be dropped.
  • If found guilty, on a serious matter. The court will sentence you to prison for an appropriate amount of time corresponding to the crime that you committed. However if you were found guilty of something smaller, you might be sentenced with home detention, conditional release, fines, or community service hours. If guilty, the defendant can ask a lower court to review a decision to see if the court was being just and fair.
