- Today we are here to discuss Mr. John's usage of 1D's "What Makes You Beautiful" and Eminem's "The Real Slim Shady" to create a horrific mashup. We will examine whether it is allowed under fair use.
- The Case of John Fair Use
- Fair use allows someone to use copyright-protected work determined by 4 factors.1. Purpose of use! John isn't profiting off his mashup and has made it purely for entertainment purposes rather than commercial use. 2. Type of copyrighted work! John uses 2 songs from different artists, but uses the songs in a way that is transformative to the originals.3. Amount of work used! John only used small samples from each song.4. Market Affect! As you can imagine, no one wanted to listen to John's mashup, so his creation didn't affect the market of the original songs!
- After looking at the 4 factors, we've decided that John's mashup is allowed under fair use! Congrats John! Even though it's a violation to our ears, it's not to the law! However, keep in mind that fair use depends on the scenario and really isn't as simple as this case has presented! Always be aware of the laws, kids! And also be aware that no one wants to listen to poorly made mashups of songs that don't go well together!
