Sandile starts the meeting with a greeting then proceeds to get on the matter of the heart and starts by introducing everyone and explains why everyone is there .As he does that he can already see the expressions on some of the people attending the meeting.
I would like to start off by greeting everyone and I believe we're all well.
Sandile starts off by asking one of the management people to give a brief background of what had occurred leading to Thandi signing a written warning and Mr. van Wyke asks that he talks. He explains that Thandi was not wearing safety gear at work and therefore had an injury which she blames the company for and tried to compensate leave leave due to the injury and payment for the days she would be on leave. It is in the duty of an employee to take care of her own health and safety and of the fellow employee. She did not obey the health and safety rules and therefore we gave her a written warning which according to the rules of the company she should sign.
I think we can all agree that the fault is Thandi's because she should have been careful and because she wasn't the company will not pay for the leave she will take.
Out of frustration Thandi tries to speak so she could defend herself but is stopped by Sandile.

Mr. Naidoo speaks and says; As you're aware that it is my job to check whether health and safety measures are effective, identify possible dangers and circumstances that may lead to major incidents, work with employer to find the causes of incidents which have occurred, investigate complaints from employees regarding health and safety, Speak to the employer about any of these matters or about general circumstances affecting health and safety;Mr. Naidoo reminds management that he came a number of times requesting that he inspect the organization and that the employees have not received their safety gears and that it is putting their lives in danger and possible injuries.
In our last meeting with management I asked about inspecting the organization but never given a day to do that.
Thandi is one of the employees who have come to Sandile and myself about not receiving safety gears ever since their start of work in GB Plastics and each time I came with that to the management of the company I am told the company is waiting for the delivery. How does Thandi not having safety gear because according to management it has not yet been delivered the employees fault when she gets an injury? I believe that the injury is not the employees carelessness or disobedient to the company rules but that of management for delaying safety gears.
Were there any safety gears given to the employees since the last time I was here regarding that? Because I don't believe that was done hence this injury.
Mr. Naidoo further defends Thandi by stating that the act of management forcing an employees to sign a written warning especially without her representatives or the shop steward is an unfair labor practice according S 186 of LRA therefore you may not continue with this written warning.
We can't do this because they fit the company only.
