  • Let us refer to the case of Loh Kooi Choon v. Government of Malaysia (1977), which dealt with a similar issue. The Federal Court of Malaysia held that the ISA was constitutional, but also emphasized that it must be exercised in a manner that was consistent with the principles of natural justice and fundamental liberties.
  • The court held that even though the ISA may restrict fundamental liberties, the rights of the individual must be protected and the ISA must be applied judiciously to safeguard national security

  • Based on the evidence and the principles established by Loh Kooi Choon v. Government of Malaysia (1977), I find that the detention of the plaintiff under the ISA was a justifiable limitation on his fundamental liberties. However, the government has a duty to ensure that the ISA is not used to suppress political opposition or dissent. I hereby order that the plaintiff be released from detention and that he be given a fair trial if he is to be charged with any offenses.
