- your “rule” which is in the Judiciary Act of 1801 is not Constitutional. Adams was outta line when he wrote that commission because that’s not the president’s job to do. So, no, you don’t get to be a judge
- Marbury shows up at the Supreme Court and yells at Madison
- the rule is that POTUS gets to invite whoever he wants to be a judge. Adams was still POTUS when he wrote the invite. He signed it. I should get to be a judge!
