  • A man named Ernesto Miranda was accused of having connections with a kidnapping and rape. He was interrogated, and wrote a letter confessing his crimes.
  • However, during the interrogation, the police officers never told Miranda about his rights written in the 5th amendment: The right to remain silent and the right to have an attorney present during interrogation.

  • "I plead the 5th!"
  • The jury ruled in the favor of Miranda, 5-4.  They said the interrogation violated the rights in the Fifth Amendment, as law officials are required to tell subject their rights during an interrogation. The police did not take the proper steps in informing Miranda of his rights.
  • Miranda v. Arizona helped in the creation of the "Miranda Rights". Miranda Rights are the rights law officials are required to tell their subjects when interrogating, or arresting them. Including the right to remain silent, and the right to have an attorney present during interrogation.
