After Corazon Aquino became the President, she abolished the 1973 constitution and replaced it with the 1986 constitution. On March 25, 1986, President Aquino signed Proclamation No. 3 entitled “Declaring a National Policy to Implements the Reforms mandated By the People, Protecting their basic rights, Adopting a Provisional Constitution, and Providing for an Orderly Transition constitution, later called the “Freedom Constitution”, was proclaimed, setting aside the 1973 Constitution thereby recognizing the new Aquino administration as a temporary revolutionary government until the framing of a new constitution. It basically adopted some provisions of the 1973 Constitution especially the Bill of Rights.
Why did Freedom Constitution formed, Sir?
The purpose was to re-organize the government and create a Constitutional Commission to make a formal Constitution for the Philippine Government after Marcos Era. President Corazon Aquino promulgated the Freedom Constitution and was drafted by Reynato Puno. It declared to be a revolutionary type of government. This constitution during its transition period from the Marcos era serves as an assurance to the Filipinos about the restoration of the democracy. Under the Freedom Constitution, the President continued to exercise legislative powers until a legislature was convened under a new constitution. Furthermore, the President was given the power to appoint the members of a Constitutional Commission tasked to draft a new charter “truly reflective of the ideals and aspirations of the Filipino people.” The Freedom Constitution was effective from March 25, 1986 to reorganization of the government.

A committee headed by Felipe Calderon and aided by Cayetano Arellano, the constitution was drafted, for the first time by representatives of the Filipino people and it is the first republican constitution in Asia. The constitution was inspired by the constitutions of Mexico, Guatemala, Costa Rica, Brazil, Belgium and France. After some minor revisions (mainly due to the objections of Apolinario Mabini), the final draft of the constitution was presented to Aguinaldo. This paved the way to launching the first Philippine Republic. It established a democratic, republication government with three branches - the Executive, Legislative and the Judicial branches. It called for the separation of church and state. The executive powers were to be exercise by the president of the republic with the help of his cabinet. Judicial powers were given to the Supreme Court and other lower courts to be created by law. The Chief justice of the Supreme Court was to be elected by the legislature with the concurrence of the President and his Cabinet.
The Republic, however, was a short-lived government. Its demise began at the start of the Philippine-American War in February 1899 and ceased to exist with the capture of President Aguinaldo in Palanan, Isabela in March 1901. By that time, the Americans had firmly established themselves as the new colonizers of the Philippines with a military government running the country. In July 1901, the formally established the first civil government in the islands.
The constitution was specifically provided for safeguards against abuses, enumerated the national and individual rights not only of the Filipinos and of the aliens.
