  • It is the opinion of the court that we affirm with Mr.Gibbons. Firstly, the regulation of navigation by steamboat operators and others for purposes of conducting interstate commerce is a right reserved to congress under the Commerce clause. Therefor, the NY monopoly is invalid as it interferes with the clause in the constitution. Secondly, I would like to further define the language in the commerce clause to include not just articles of interstate trade, but also the intercourse among the states, which in this case includes navigation. The purpose of the commerce clause and this ruling is to maintain free trade.
