  • Hi Paul, just wanted to let you know that I am heading off to the Brisbane Correctional Centre for my visit with Mr Murphy. I filed the notice of appeal for Mr Alan earlier today as well.

  • Good Morning! First, can you please complete these forms. Officers will escort him to the interview room shortly.
  • Hi, I'm here to see my client Mr Jack Murphy.
  • We will see what we can do, let's take a seat.
  • Hi Jack, I am Ben! Thanks for joining me. How are you?
  • Miserable, you've got to help me get out of here mate.
  • So Jack, you have been charged with murder. The victim is your step-daughter. Is that correct?
  • And do you understand what this means?

  • Jack, murder is an incredibly serious offence that comes with significant consequences if found guilty. Defendants in a criminal proceeding are all entitled to being considered innocent. You are the last known person to have seen Bella before she went missing after you signed her out of school. After reading through important documents prepared by the Queensland Police, they are concerned that no witnesses report seeing you at the park and that your phone pinged in a completely different region than what was mentioned in your alibi. The last sighting was video surveillance of you fuelling up with Bella in the car. She is sadly presumed deceased. Physical evidence such as blood in your car boot and scratches to your face are of a highly convicting nature.
  • No, I'm telling you now that I had nothing to do with this. Bella was so important to my partner, I couldn't do something like that to them both. Like I said in the police interviews, we were at the local playground in our suburb and she must have wandered off when I went to my car. I'll never forgive myself.
  • Given how serious the charges against you are, Paul Myers, a senior partner at our firm, will be leading your case. Depending on your plea, we may also need to appoint and prepare a brief for counsel - so essentially, a barrister that is experienced in murder cases.
  • I understand your frustrations Jack and I appreciate the level of trust you have for me. However, it is in your best interests that Paul is your main solicitor as he has represented many clients facing similar charges before.
  • Are you serious mate? I didn't ask for that, tell them not to bother because I'm happy with just you.
  • Alright, I trust you guys.
  • As the body has not been found, this usually makes establishing your guilt more difficult and involves lots of complicated evidence.
  • Between now and Paul's visit, you may like to have a think about your plea. He will provide advice, but at the end of the day it is ultimately your choice and you must make your decision with your own free will.
  • That is fine Jack, it is always your decision. It is important that you understand the consequences of each option and that we inform you of these.
  •  I'm not guilty, why would I plead guilty? Are you not listening to me?
  • I can see that you have a previous conviction for breaching the terms of your domestic violence order. Is that correct?
  • Here we go. That was from my partner before. I just wanted to see her but I suppose it doesn't do me any favours now.
  • Thank you for telling me the truth Jack. It will help us to inform you better and help defend you best.
  • This is all too much! Bella had been causing trouble between my partner and I for months. I lashed out and buried the weapon at my parent's cabin house while they were on holidays. You can't tell anyone but her body is in the Mt Cootha area. I thought it would be easier living with the guilt but I had to tell someone.

  • Don't you dare tell anyone. I might be guilty but there is no way I'll be pleading guilty.
  • I think it is best if we leave it at that today. Have a think about what you might like to discuss with Paul, his meeting with you is next Monday at 10am. I will record that I have discussed certain things with you so Paul knows where we are up to. Take care, Jack.
