- Defense: In capital cases an attorney is provided, and neither the 6th nor the 14th amendments differentiate between the types of cases.
- During Betts v. Brady fewer than half of the states required appointed counsel, but during Gideons arrest 45 did.
- Plus taxes would rise if everyone was appointed counsel, and it's still possible to have a fair trial if many judges are involved.
- Okay, but Betts v. Brady is only 21 years old and ruled that counsel is only provided under special circumstances.
