Actus Reus + Mens Rea (Intent)

This is an example of Actus Reus and Mens Rea with intent. Both people were angry and made the decision to commit a crime. The actus reus for mischief would be established because they used objects available to them to break the windows of the cafe. There is also mens rea because they made the conscious decision to destroy the storefront due to their anger. They would be charged under Section 430(1) of the Criminal Code for mischief as they willfully destroyed property. They could also be charged with Section 298 (1) of the Criminal Code for defamatory libel if they did in fact post online about the owner even though they were not present.
