  • Peter: So where do we begin?Girl: Lets start with the benefits of joining a trade union.Boy: i read about that
  • Workers who join a trade union have the benefit of being part of an organized group. Topics such as paid maternity leave and safety in the workplace are dealt with as a group. Unions can also help with other aspects of working life such as accompanying you to a disciplinary hearing.
  • I know! Bargaining councils are formed by registered trade unions and employers to try to resolve disputes over collective agreements. They may also manage pension funds, sick pay, unemployment and training schemes, and other such benefits for their members.
  • What is a bargaining Council?
  • Its a Saturday morning and the three friends have gathered by Peters house and getting ready to discuss trade unions.
  • A collective agreement is an agreement between employers and employees which regulates the terms and conditions of employees. It is a legally enforceable instrument, which generally lasts as long as each parties' bargaining cycles. It could also be a long-lasting agreement, or one which is terminated after reasonable notice by either party.
  • With that being said, does anyone know what a collective agreement is?
  • Here the students are discussing the benefits of having joined a trade union.
  • Girl: What are strikes and lockout?Boy: The right to strike is entrenched in Section 23 of the Constitution. Employers have a reciprocal right to lockout, which is also in the constitution. While strikes and lockouts are legal, a very strict procedure must be followed. This includes referring the dispute for conciliation, then undergoing a waiting period, and finally giving notice of the strike.
  • The students are discussing what bargaining councils.
  • South Africa's labour laws prohibit strikes and lockouts in essential services and maintenance services. This would include medical staff and police staff, the parliamentary service and South African Police Services. Employers and employees should refer their disputes to final and binding arbitration, the LRA says.
  • Can one take place in a strike if you work in an essential service?
  • They then continue to discuss what a collective agreement is and how it works
  • Here they make mention of strike sand lockout - they are discussing what a strike is and a lockout
  • They then go into detail on who may and may not join strikes.
