  • Alexandra attends a party for her company at a local bar, just blocks away from her home.
  • This is such a great office party! I really need to get out like this more often!
  • Definitely! What a great turnout this year!
  • Meanwhile, a young student named Emma decides to take a trip to the local library.
  • Tonight would be a great night to drive to the library to get the new book that I need for school...
  • Alexandra, realizing that it is getting late, feels a sudden urgency to get home. She is tired and does not want to wait for an Uber or Taxi, or a ride from a designated driver. She figures that she is close to home, so she would be okay to drive.
  • No, why would I spend money on a ride when I'm only a few blocks from my house? I'll be okay.
  • Oh, I did not realize what time it was! I really should be getting home soon..hmm.. Uber? Taxi?
  • No, no, you stay here and have a good time. I'm only a few blocks away from my place!
  • I'd better get going. The cats aren't going to feed themselves!
  • You don't have any cats...I should probably give you a ride, you have been drinking.
  • And leave my car here overnight? Not going to happen. Stop worrying, I can handle a few blocks.
  • ...Did you know that two 8 ounce glasses of wine over two hours for an 120 pound female could cause a blood alcohol level of 0.08? You've had two glasses and we have only been here for a couple of hours. I really do not think you should drive.
  • I don't know what she was so worried about. It's not driving dangerously if you're only a few blocks away, right?!
  • After taking a new book out at the library, Emma is on her way home.
  • Alexandra speeds through a red light, nearing Emma's vehicle.
  • After taking a breathalyzer sample which determined that Alexandra was above the legal limit, she was detained at the scene.
  • Ma'am, have you been drinking? I am going to need to take a breathalyzer sample.
  • But I only had a few drinks!
  • Several hours later, Alexandra is placed in a holding cell. She reflects on the criminal negligence and wrongful act that she has committed.
  • I made a huge mistake. How could I have been so oblivious to the consequences of my actions? I sure hope the girl will be okay.
  • Emma's parents are given the tragic news of their daughter's death.
  • The emergency personnel did everything they could to try and save your daughter. I am very sorry to tell you that Emma was killed by an impaired driver this evening.
  • A police officer informs Alexandra of her charges.
  • The victim has died as a result of the injuries she sustained in the collision. You are being charged with one count of impaired driving causing death, one count of driving over the legal limit, and one count of dangerous driving causing death.
  • Several months later, Alexandra's sentencing hearing takes place. Emma's parents are seated in the courtroom, becoming emotional as the details of the collision are recounted. A pre-sentence report, along with a victim impact statement was prepared.
  • [Judge] Section 718.1 of the Criminal Code of Canada states that a sentence for those found guilty of a criminal act must be given a sentence that is proportionate to the gravity of the offence and the degree of responsibility of the offender.
  • The actus reus and mens rea have both been thoroughly proven, as the accused committed the wrongful act, and displayed recklessness by taking an unjustifiable risk by refusing to accept a car ride from a designated driver.
  • It has been determined that the accused has been found guilty of the indictable offence of impaired driving causing death, with a general intent, as the intent was limited to the prohibited act itself.
  • Alexandra was found guilty on all of her charges, and plead guilty to each one. Information was gathered, and lawyers on either sides argued until a verdict was decided.
  • Due to current legislation, there is no minimum sentence for the crime of impaired driving. The maximum penalty, life imprisonment, has never been used in Canada. Comparable sentences in Canada range from 5 to 10 years imprisonment.
  • Based on precendent cases of impaired driving, along with the evidence and information brought forward in court today, I hereby sentence you, Alexandra Stone, to 10 years in a federal penitentiary.
  • They should have given her a life sentence, it would only be fair. She took our daughter's life, now the legal system should take hers. 10 years is not enough.
  • Alexandra also had to pay millions of dollars in civil damages to Emma's family.
  • This money will not bring our daughter back, but at least it is something.
  • Alexandra is currently serving her sentence in a federal penitentiary. She may be eligible for parole after serving one third of her sentence. However, Emma is gone forever.
