Under the Judiciary Act of 1807, Federalist President John Adams created the Midnight Judges. This was a small group of federalist judges created so that their party would have power in the courts.

William Marbury, a businessman from Maryland applied to be a Midnight Judge and was accepted.

As a final step to becoming a Midnight Judge, Founder James Madison was supposed to deliver Marbury's commission so he could begin his new role. However Madison refused to deliver.

Angered, Marbury decided to take the matter to court and asked for a Writ of Mandamus. This would require Madison to deliver the commission.
Chief Justice John Marshall decided that although Marbury was entitled to the commission, issuing a Writ of Mandamus was unconstitutional.
