  • After Thomas Jefferson wins the election against John Adams, Adams is furious of his defeat and becomes a lameduck president where he still remains in power but will be replaced. Adams devises a plan to ruin Jefferson's presidency!
  • John Adams
  • Jefferson will DEFINITELY pay for his actions. After so many hours, I have come up with a plan. 
  • I will appoint federalist judges in courts throughout the country. Now Jefferson has to deal with federalist courts! HAHAHA!
  • To put his plan into play, Adams calls his secretary of state, John Marshall, and orders him to deliver the commissions or the confirmation for the job to the federalists. Marshall was also appointed the Chief Justice of the Supreme Court!
  • PLEASE don't fail me Marshall. This is our last hope in ruining Jefferson's presidency. We don't have much time left before we leave!

  • No problem Mr.Adams! I mean, it can't be that hard to give commissions. Right? How can I possibly mess this?
  • As Marshall is giving out commissions, he runs out of time. Adams and his people have to leave the office as Jefferson and his people will replace them! Adams' plan was not successful.
  • Oh no! I still have some commissions to give and my time has run out! I'll just leave the rest for Jefferson's secretary of state, James Madison.
  • Marshall had left commissions for Madison, who is the opposing party, to give to federalist members! Thomas Jefferson makes sure madison doesn't send out the commissions.
  • DON'T do it Madison! Adams has devised a plan and is trying to get us in huge trouble! Don't give those commissions!

  • Marshall left some commissions for me and he wants me to give it to federalist members. What do I do Mr.Jefferson?
  • William Marbury was one of Adams' last appointments and was furious that he didn't get his commission to get his job! Marbury decided to take action under the Judiciary Act of 1789 which gives the supreme court the power to issue court orders. Court orders - an order that forces the person to comply!
  • THE AUDACITY to decline my commission! How clever, Jefferson! I'm suing and demand that the supreme court issue a court order!
  • Marshall, who was appointed the chief justice of the supreme court, was to deal with Marbury's request. He asked himself 3 questions in order to decide what to do!
  • Did William Marbury have a right to the job?
  • YES!
  • Could courts issue court order to force officials to do their duty.
  • YES!
  • Does the Supreme Court have the power to issue the requested court order?
  • NO!
