Marbury cited the Judiciary act of 1789 which gave Supreme Court the power of Judicial review against any case with a government official, Marbury became the plaintiff
Now hold on there, that act gives the court power, but it comes from the congress. The Supreme Court can only have power from the Constitution. 
The court's power needs to come from the constitution, not from congress, so congress didn't have the right to give the Supreme Court power under the Judiciary act.
