- Today we are going to deal with an important topic that happened in the year 1974 called "UNITED STATES V. NIXON".
- A grand jury returned indictments against seven of President Richard Nixon's closest aides in the Watergate affair.
- Is the president's right to safeguard certain information, using his "EXECUTIVE PRIVILEGE" secrecy power completely immune from judicial review?NO. The Court held that neither the doctrine of separation of powers, nor the general need for confidentiality of high-level communications, without more, can support an absolute and unconditional presidential privilege. The Court conceded that there was limited executive privilege in areas of militaryor diplomatic affairs, but gave preference to "the fundamental demands of due process of law in the fair administration of justice," Therefore, the president must obey the summons and present the tapes and documents. Nixon resigned shortly after the release of the tapes.
- The Nixon-appointed special prosecutor and the defendants searched for audio tapes of convesations recored by Nixon in the Oval Office.
- Nixon claimed he was immune from subpoena on the grounds of "executive privilege", which is the right to withhold information from order branches of government in order to preserve confidential communications within the executive branch or to ensure the national interest. Decided in conjunction with Nixon v. United States.
